LIMITED WARRANTY ON LIFECLOCK BY RIDGEWOOD WATCH CO.

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.

THE LIMITED WARRANTY CAN ALSO BE FOUND ONLINE AT WWW.LIFECLOCKONE.COM /WARRANTY AS WELL AS IN THE DOCUMENTATION WE PROVIDE WITH THE PRODUCT.

WE WARRANT THAT DURING THE WARRANTY PERIOD, THE PRODUCT WILL BE FREE FROM DEFECTS IN MATERIALS AND WORKMANSHIP WHEN USED NORMALLY FOR ITS INTENDED PURPOSE.  HOWEVER, ALL SOFTWARE PROVIDED WITH THE PRODUCT IS PROVIDED “AS IS.”  WE DO NOT WARRANT THAT THE OPERATION OF THE PRODUCT WILL BE UNINTERRUPTED OR ERROR-FREE.

WE LIMIT THE DURATION AND REMEDIES OF ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY.

SOME COUNTRIES, STATES OR PROVINCES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF IMPLIED WARRANTIES OR THE LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES OR ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

 WHEN IMPLIED WARRANTIES MAY NOT BE EXCLUDED IN THEIR ENTIRETY, THEY WILL BE LIMITED TO THE DURATION OF THE APPLICABLE WRITTEN WARRANTY. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS; YOU MAY HAVE OTHER RIGHTS THAT MAY VARY DEPENDING ON LOCAL LAW. YOUR STATUTORY RIGHTS ARE NOT AFFECTED.

OUR RESPONSIBILITY FOR DEFECTIVE GOODS IS LIMITED TO REPAIR OR REPLACEMENT AS DESCRIBED BELOW IN THIS WARRANTY STATEMENT.

 

WHO MAY USE THIS WARRANTY?

Ridgewood Watch Co., LLC, (”we”) extend this limited warranty only to the consumer who originally purchased the product (”you”). It does not extend to any subsequent owner or other transferee of the product.

 

WHAT DOES THIS WARRANTY COVER?

This limited warranty covers defects in materials and workmanship of the LIFECLOCK BY RIDGEWOOD WATCH CO. watch (the “product”) for the Warranty Period as defined below.

 

WHAT DOES THIS WARRANTY NOT COVER?

This limited warranty does not cover any damage due to: (a) transportation; (b) storage; (c) improper use; (d) failure to follow the product instructions or to perform any preventive maintenance; (e) modifications; (f) unauthorized repair; (g) normal wear and tear; or (h) external causes such as accidents, abuse, or other actions or events beyond our reasonable control (e.g. heat damage).  Nor does the limited warranty cover software, including (without limitation) (i) the operating system and software pre-loaded on the Product, (ii) third-party software, or (iii) the reloading of software, software configurations or any data files to the Product after purchase.

 

WHAT IS THE PERIOD OF COVERAGE?

This limited warranty starts on the date of your purchase and lasts for ninety (90) days (the “Warranty Period”). The Warranty Period is not extended if we repair or replace the product. We may change the availability of this limited warranty at our discretion, but any changes will not be retroactive. The Warranty Period for any repaired or replaced Product shall be the balance of the original warranty or for thirty (30) days from the date returned to the consumer, whichever is longer.

 

WHAT ARE YOUR REMEDIES UNDER THIS WARRANTY?

With respect to any defective product during the Warranty Period, we will, in our sole discretion repair or replace such product or the defective part free of charge. However, you will be responsible for pay for shipping and handling fees to return the repaired or replacement product to you.  We will notify you as to the fee for shipment upon receipt of the Product and issue an invoice to cover the costs which shall be paid in advance.

 

HOW DO YOU OBTAIN WARRANTY SERVICE?

To obtain warranty service, you must email our Customer Service Department at support@lifeclockone.com during the Warranty Period to obtain a Defective Merchandise Authorization (”DMA”) number. No warranty service will be provided without a DMA number.  You will ship the Product to the address Customer Service Provides with a form that we will send you for tracking purposes.  We highly recommend that you adequately protect the Product, and insure the package, for shipment. We are not responsible for product lost or damaged during shipping.

 

LIMITED WARRANTY AND LIMITATION OF LIABILITY

ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED TO THE DURATION OF THE APPLICABLE WARRANTY PERIOD. ALL OTHER EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS AND WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF NON-INFRINGEMENT, ARE DISCLAIMED.

THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT, NOR SHALL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT, OF ANY KIND, OR LOSS OF REVENUE OR PROFITS, LOSS OF BUSINESS, LOSS OF INFORMATION OR DATA, SOFTWARE OR APPLICATIONS OR OTHER FINANCIAL LOSS ARISING OUT OF OR IN CONNECTION WITH THE ABILITY OR INABILITY TO USE THE PRODUCT OR SOFTWARE TO THE FULL EXTENT THESE DAMAGES MAY BE DISCLAIMED BY LAW

RETURNS NOT COVERED BY THIS LIMITED WARRANTY.

 The Limited Warranty shall not apply to a Product that does not meet the requirements of this Limited Warranty, including (but not limited to) a Product that (a) lacks a valid DMA Number, (b) is not accompanied by a valid Proof of Purchase, (c) is no longer covered under the Warranty Period, or (d) does not have a defect covered by this Limited Warranty, you may be responsible for an assessment fee, return shipping and handling fees, and other reasonable fees as may be required prior to the Product being returned to you.

 

SOFTWARE/DATA BACKUP.

Repair of the Product may result in loss of data.WE WILL HAVE NO LIABILITY FOR LOSS OF OR RECOVERY OF DATA, SOFTWARE, PROGRAMS, OR LOSS OF USE OF THE PRODUCT. Under no circumstances will we be responsible for any loss of data, software, or programs, even if our technicians have attempted to assist you with your backup, recovery or similar services. Any such assistance is beyond the scope of this Limited Warranty. Following service under this Limited Warranty, your Product may be returned to you as configured when originally purchased, subject to applicable updates. You will be responsible for reinstalling all other data, software and programs.

 

WHAT CAN YOU DO IN CASE OF A DISPUTE WITH US?

This Warranty and the rights and obligations of the parties will be governed by and construed and enforced in accordance with the laws of the State of Georgia, without regard to conflicts of law principles. You expressly agree that the provisions of the United Nations Convention on Contracts for the International Sale of Goods will not apply to the Warranty. All disputes arising under or in connection with this Warranty will be finally settled under the Rules of Arbitration of the American Arbitration Association by one arbitrator appointed in accordance with the Rules. The language of the arbitration will be English. The place of the arbitration will be Atlanta, Georgia. Judgment upon any award rendered by the arbitrator may be entered in any court having jurisdiction.
